To be more precise, this statute applies only to residences that are not "one or two family dwellings," so it does not apply to single family homes. In any event, fire safety is about common sense and responsibility, so all should be aware of the risks and exercise the utmost caution in any residential setting.

I certainly understand your frustration with the lack of snow removal. That's government for you.

As I understand it, the HOA is not allowed to plow county streets. Just like we're not allowed to install traffic-calming devices. The roads are owned by the county, and we're not allowed to do much but drive and park on them. I hope someone from the BOD or Landscaping committee will chime in to correct me if I'm wrong.

And in case you didn't realize, single-family homeowners pay significantly lower monthly HOA fees precisely because the HOA does not have to pay to plow and maintain your streets. If we were allowed to plow your streets (and paid the contractor to do so), your dues would go up significantly (at least $30 more monthly).

I'm sure I'm not the only single family homeowner dissatisfied with snow removal efforts in our area recently since my neighbors have expressed similar comments to me. I understand that the policy is that the County is responsible for snow removal around the single family homes. But, the County says they will not remove snow from cul-de-sacs for anywhere from 2 to 5 days after a major snowfall. That is unacceptable to many of us who need to get out of our courts to pick up supplies, go to work, etc. Since the County won't change its policy for me, the HOA needs to change its policy. Those of us in single family homes are paying monthly dues just like the people in townhouses. Part of the reason for those dues is so the HOA will maintain the streets, which in my mind includes snow removal so residents can access those streets safely. If a contract already exists to plow the area around the townhouses, it seems to me that the contract should be modified so the same company also can plow the streets around the single family homes since they already are in the area providing the service we need.

Tracey Warren, Vice President of the BOD, issued the following statement on 12/21:

<blockquote>
We were informed by ProCom that sections 5 and 6 had been turned over to the County. Obviously there is some disconnect. We are addressing it. We apologize to the community to those that have been inconvenienced. At this time, 99.9% of the streets in the Community have been plowed.

An aside: There were complaints from homeowners in the cul de sacs regarding the lack of snow removal. We have been told that cul de sacs are typically addressed last.
</blockquote>

And the following today, 12/28:

<blockquote>
Tolman was plowed and salted on Monday by a private contractor. Collete was plowed by the county and by the private contractor. My husband Robert witnessed both.
</blockquote>

Hopefully this helps.

Thank you for the reply. I have called the county and they are aware of the problem. Hopefully this will not happen in the future. I appreciate the quick reply from you. Thanks!

Sue,

I certainly understand your frustrations. But you're directing your anger in the wrong direction. As has been mentioned a number of times, Tolman Lane and all the other roads the single-family homes are on are county-owned. This means the county (alone) is responsible for snow removal and trash pickup. The HOA does not and cannot take care of these functions on county-owned roads. Please complain to the county, as have others. The more who complain, the more likely something will be done.

The snow stopped early sunday morning. Tolman Lane did not see ANY snow plow at any time. The plows came through for the main street, but never for Tolman Lane. I ask, what is the monthly payment for the HOA for?? Maybe I should just cut the monthly fee in half, since snow removal apparently does not include for Tolman lane. No trash pickup on Tolman either - because the truck would not try to come down the street on ice. Trash removal came on the main street in the community. What seems to be the problem. More snow is being predicted for New Years Eve. Will there be any plows/snow removal/salt for Tolman lane???

Mike,

 Thanks. I was as surprised as you were about the response on the county website. I actually put the house number in the form but took it out of my post. I am in the process of calling now.

The county says:
The address: STAR STELLA DR is on a privately owned road. Your street is not owned or maintained by Anne Arundel County. Snow removal service is the responsibility of the owner of your street.
</blockquote>

What??? This is news to me, and is almost certainly a mistake. I will make sure the BOD is aware of this declaration by the county. I was under the impression that all roads in Chapel Grove have been turned over from the builder to the county. Hmmmmmmm........

Keith,

As mentioned, the HOA only contracts/pays to have our private roads plowed (in the townhome section). Star Stella and the other roads in the single-family home area are all county owned, and so it's up to the county to plow there. Unfortunately we have no control over that whatsoever. Your best bet (?!) is to call and complain to the county.

The snow stopped on Saturday night and there has been no snow plowing in the back of the subdivision. When are we going to see plowing taking place. It is very hazardous driving on Star Stella Dr.
